In California, there are several different types of domestic violence charges.
Some, such as inflicting injury on a spouse, cohabitant, or fellow parent resulting in traumatic condition, require that there be SOME form of injury.
Others, such as simple Battery against spouse, cohabitant, or fellow parent, do not require any type of injury of any kind.
The mere absence of injuries does not preclude the prosecution from filing charges of domestic violence against someone.
There are a wide array of charges that qualify as domestic violence that do not even require any physical touching of any kind.
However, the absence of injuries CAN help to discredit an accuser who has claimed to be the victim of extremely violent conduct.
