What Is The Penalty For Battery Causing Serious Bodily Injury (243(d)) In Riverside County or Orange County, California?

Because Battery causing serious bodily injury PC 243(d) can be charged as either a misdemeanor or felony, the sentencing varies considerably.

If convicted as a MISDEMEANOR, punishment could include:

• Up to 1 year of jail
• A 10 year prohibition on firearm ownership / possession pursuant to PC 29805
• Confiscation/destruction of the weapon
• Criminal Protective Order (Restraining Order)
• Up to 5 years of Summary (informal) probation
• Participation in a Batterers or Anger Management Programs
• Restitution

If convicted as a FELONY, the potential punishment depends upon whether or not you are given probation by the Judge. Also, a conviction of PC 243(d) Battery Causing Serious Bodily Injury could constitute a “Strike” for purposes of California’s Three Strikes Law.

IF granted probation:

• Up to 1 year of jail
• A lifetime ban on firearm ownership / possession
• Confiscation/destruction of the weapon
• Criminal Protective Order (Restraining Order)
• Up to 5 Years of Formal Probation
• Participation in Batterers or Anger Management Program
• Restitution

IF denied probation:

• Either 2, 3 or 4 years in county prison (Possibly an additional 3 years if the injury is “Great Bodily Injury”, a “Strike”)
• A lifetime ban on firearm ownership / possession
• Confiscation / destruction of the weapon
• Ineligible for future reduction to a misdemeanor pursuant to PC 17(b)
• Restitution
