Because Battery On A Peace Officer or Medical Personnel With Injury (PC 243(c)(2) can be charged as either a misdemeanor or felony, the sentencing varies considerably.
1. Up to 1 year of jail
2. Up to $10,000 in fines
3. A 10 year prohibition on firearm ownership / possession pursuant to PC 29805
4. Confiscation/destruction of the weapon
5. Criminal Protective Order (Restraining Order)
6. Up to 5 years of Summary (informal) probation
7. Participation in a Batterers Program
8. Restitution
Also, a conviction of PC 243(c)(2) Battery on a Peace Officer with Injury could constitute a “Strike” for purposes of California’s Three Strikes Law if the injury is severe enough.
1. IF granted probation:
a. Up to 1 year of jail
b. Up to $10,000 in fines
c. A lifetime ban on firearm ownership / possession
d. Confiscation/destruction of the weapon
e. Criminal Protective Order (Restraining Order)
f. Up to 5 Years of Formal Probation
g. Participation in Batterers Program
h. Restitution
2. IF denied probation:
a. Up to $10,000 in fines
b. Either 16 months, 2 or 3 years in county prison
c. A lifetime ban on firearm ownership / possession
d. Confiscation / destruction of the weapon
e. Ineligible for future reduction to a misdemeanor pursuant to PC 17(b)
f. Restitution
