Domestic Violence Amid COVID-19

Posted in Criminal Defense,Domestic Violence,Domestic Violence FAQ'S on April 22, 2020

The coronavirus pandemic has dramatically affected the way of life for most people in this country. While quarantine and stay at home orders have been enacted in most areas of the country to prevent the spread of COVID-19, these orders have had various unintended consequences, particularly when it comes to domestic violence. Without a doubt, these orders have put people into dangerous situations within their own household. Here, we want to discuss a rise in domestic violence claims as well as what a person can do if they face false allegations of domestic violence.

Is There an Increase in Domestic Violence Claims?

Many police departments around this country have reported an increase in domestic violence calls during coronavirus-related lockdowns and stay at home orders. This is an unfortunate reality of the global health crisis.

Not only has this pandemic led to the necessity of people having to stay home more than normal, but it has created additional mental health challenges. With a constant barrage of news and anxiety related to COVID-19, many people may be put into challenging situations within the homes. This pressure could result in a sort of “pressure cooker” for potential violent actions against members of a person’s household.

What You Can Do About False Allegations

Unfortunately, there are times when a person is falsely accused of domestic violence. There are various reasons that a person may use false claims of physical or emotional abuse. A person could make false allegations in order to:

  • Get their significant other out of their life
  • Win child custody battles
  • Gain possession of a spouse or domestic partner’s property or assets
  • Get even with someone who wants a divorce

Due to the tragic and devastating history of domestic abuse, it is not uncommon for law enforcement to assume that anybody making an allegation of domestic violence is telling the truth. It is also not uncommon for prosecutors to be biased against the perceived dominant partner in the relationship (which, in many cases, is the male).

If you have faced false accusations of domestic violence, there are some steps you can take to protect yourself.

  • Seek help from an attorney immediately. Do not hesitate to seek assistance from a skilled domestic violence defense attorney. These cases can become complicated, and an experienced attorney will ensure you are treated fairly.
  • Do not breach any restraining order. If any restraining orders or other enforcement orders are issued, do not breach them. This will only work against you in the criminal case.
  • Continue to be a good parent. If you have children, a false accusation could result in a loss of your parental rights. Speak to your attorney about how to proceed with ongoing domestic violence allegations when you have minor children.
  • Stick with your defense. Do not change your story or give contradicting accounts of what happened. If you have maintained your innocence from the beginning, stand by your claims and listen to the advice of your attorney.
  • Stay focused. Stay calm and focused during all court proceedings related to the domestic violence case. Do not be baited into an emotional or angry outburst.
